Charges and Penalties for DWI in Texas

The legal sanctions for a DWI conviction escalate with each incident: 

  • First offense: Up to a $2,000 fine, up to 180 days in jail, and driver’s license suspension for up to a year.
  • Second offense: Up to $4,000 fine, a jail sentence of at least one month, and perhaps as long as a year. The driver’s license can be suspended for as long as two years.
  • Third offense: A driver’s license can still be suspended for two years. That’s in addition to a fine that can now reach $10,000 and a prison term that will be a minimum of two years and potentially 10 years.
